Description

Authorize to enter into Interagency Agreements with Local Education Agencies (LEAs) statewide to facilitate the continuation of the Medicaid to Schools (MTS) Program federal claiming and to provide Early Periodic Screening, Diagnosis and Treatment (EPSDT) services in accordance with Title XIX of the Social Security Act. The current federal claiming method is being sunset by the Centers for Medicare and Medicaid Services (CMS) as of June 30, 2026. (2) Further authorize to utilize the attached template Interagency Agreement for the Interagency Agreement between it and the LEAs without change, except to add the name of the LEA who is a party to the Interagency Agreement and to include execution by the parties. This template has been approved as to form and substance only by the Attorney General’s Office. (3) Further authorize not to present the executed Interagency Agreements to G&C because the terms of the Interagency Agreement between the parties will not be changed. The Department of Health and Human Services, Division of Medicaid Services, will, however, submit the executed Interagency Agreements to the Attorney General‘s office for review and approval as to execution. (4) Contingent upon approval of Requests #1, #2, and #3, further authorize to make unencumbered federal payments in an amount not to exceed $10,000,000 in the aggregate to reimburse the LEAs for the Title XIX federal share of actual and reasonable costs to LEAs which will be made through the Certified Public Expenditure (CPE) process. Under the CPE, the LEAs certify their expenditures and the Department claims the federal Medicaid matching funds. All requests shall be effective July 1, 2026, upon G&C approval through June 30, 2027. 100% Federal Funds
